Many workers, employees, and individuals do not even realize they may be entitled to both short and long-term monthly income disability through private insurance companies which their employer has in place under a group plan. In many instances, the employer does not inform the worker, so that they do not file their application on time, which the insurance company may attempt to take advantage of to deny benefits, although it was not the worker’s fault.
Employees may erroneously be told either by their employer or even the insurance companies themselves that if they are eligible for WSIB, they cannot apply for group employment income replacement benefits through the employer’s policy, which may or may not be accurate.
In fact, if there is a plan in place, the insurer may be required to make monthly payments (usually 2/3 of gross pay) if you are disabled, each according to the individual policy – so long as WSIB and/or CPP does not pay. When, and if WSIB and/or CPP make a payment, the insurer will be repaid from any retroactive payment to reimburse what they have paid or reduce those benefits accordingly.
In the event the insurer denies your application, your only remedy is to bring a court action against them. Our long/short term disability law firm routinely does this in addition to our continuing representation on your behalf before WSIB and CPP. .
Short-term disability (STD) coverage may vary, depending on the policy. Long-term disability (LTD) is usually to age 65 but not always. It will apply after STD benefits expire, and is usually comprised of two parts, the first part of the policy usually applies the two year test, being whether you can work at your old job . After two years, the test changes to whether you are able to work at any job which your experience and skills permit.
NOTE: A Paralegal is prohibited by law from representing you in ANY of these matters including not being permitted to even correspond with insurance companies on your behalf, ONLY lawyers are permitted to do this.
